I. Non-Sexual "Hurting" Allegations:

• J.R. told her mother that "a mean clown would yell and say bad words to kids." (Interviews, p.257)

• In the first official interview on 9/13/84, J.R. said that there was "a big lady with a camera taking pictures of children." Asked if the children were undressed, or if anyone touched J.R.'s body, the report says that J.R. was "unable" to say. (Interviews, p.252); emphasis added.
• At the second interview on 9/18/84 J.R. said that Miss Cheryl "took pictures of the children in the secret room, both with and without clothes on." (Interviews, p.253)
• When asked about other adults in the room with the picture-taking, J.R. "hesitantly identified (a 'big man') as Tooky," When asked if any adults had touched her body, J.R. said, "I don't know." (Interviews, p.254)
• Mother said J.R. told her that someone took pictures of naked children, including J.R. There was a movie projector too. (Interviews, p.257)
• At trial, on direct, J.R. first said she didn't remember having her picture taken while naked. Then she said it did not happen. When she asked this question for the third time, J.R. said her clothes were off and it happened in the "secret room." (Vol. 22, pp.130-131)

• J.R. does not know who took the pictures. (Id., pp.131-132)

• J.R.'s allegations are primarily about elephants, not clowns. The Fells Acres Day School made trip to the local zoo, and they saw puppet shows. (Vol. 47, p.103)

J.R.'s elephants are sometimes male, sometimes female. Sometimes they are good and sometimes they are bad. See the categories below.
• J.R. told detective Byrne that there was a clown in the "secret room." (Interviews, p.254)

• J.R. said that in the "magic room" a big lady took pictures of the children. (Interviews, p.252)
• At the second interview on 9/18/84, J.R. said that there was an elephant in the "secret room" upstairs at Fells Acres Day School. Some children, but not J.R., were naked and "played games" there. (Interviews, p.253)
• A clown came into the "secret room" with her. (Interviews, p.254)
• After leading questions by Susan Kelley, J.R. says that Miss JoAnne put her fingers in J.R.'s vagina in the "secret room" while Miss Anne Marie took pictures. (Pre-Trial Reports, p.323)
• In the "magic room" they "did the magic stuff." (Pre-Trial Reports, pp.293-294)
• In the 9/18/84 report by detective Byrne J.R. said that she had gone upstairs to a "secret room" with Miss Ann Marie, Miss Alice and Miss Cheryl. (Vol. 41, p.117)
• At first not remembering, then denying, when asked a third time on direct at trial J.R. said that she was naked in the "secret room" when pictures were taken of her. (Vol. 22, pp.130-131)
• During an inspection tour of Fells Acres Day School in 1985 J.R. said the "secret room" was on the top floor left, facing the front of the house. (Vol. 23, p.162)

• The mother doesn't remember J.R. saying that two teachers, Miss JoAnne and Miss Anne Marie, were present when Tooky brought J.R. to the "secret room." (Vol. 24, p.99)
• J.R. went to the "secret room" with her teacher. While there they "played with toys, cabbage patch toys." (Pre-Trial Reports, p.313)
• "Mommy" took J.R. to the "secret room." (Pre-Trial Reports, p.327)
• There was a gray elephant in the "secret room." She forgets if the elephant's private parts were showing. (Pre-Trial Reports, pp.332-333)
• "They showed us about the movie.... the cabbage patch movie and the elephant movie." (Pre-Trial Reports, p.336)
• J.R. played the elephant games and the cabbage patch games with her clothes on. (Pre-Trial Reports, p.337)
• At trial, J.R. doesn't remember any "special room" or a "hiding room." (Vol. 23. P.33)

• At the grand jury the mother says that J.R. told her that she was forced to take off her clothes. (Grand Jury, 1/18/85, pp.10-11)

• At the first official interview on 9/13/84 J.R. "was unable to say if children were dressed or undressed .... J.R.'s response to questions was "I don't know.'" (Interviews, p.252; emphasis added).
• She played the elephant games and the cabbage patch games in the "secret room" with her clothes on. (Pre-Trial Reports, p.337)
• At the second interview J.R. "denied that she had to take her clothes off." But "she was able to say" that the other children were naked. (Grand Jury, 1/16/85, pp.146-147; emphasis added).
• J.R. doesn't know who took pictures of naked children. (Vol. 22, pp.131-132)

• J.R, forgets if the elephant's private parts were exposed in the "secret room." (Pre-Trial Reports, p.333)
• She never saw a penis on an elephant. "He just had a tail." It was a "nice elephant." (Pre-Trial Reports, p.338)
• She never saw a clown without clothes on. (Pre-Trial Reports, p.345)

• J.R.'s father testified that in the evening, after the fruitless first official interview on 9/13/84, J.R. suddenly told him about "an elephant game .... you lick ice cream off the elephant .... on Tooky's lap." (Vol. 23, pp.110-111)
• Mother said that J.R. told her that there was a pink elephant in the "secret room." There was ice cream on the elephant's trunk "and J.R. was made to lick the ice cream off ...." When her grandfather questioned her, J.R. said that "the elephant was on Tooky's lap." (Interviews, p.255)
• Mother says J.R. placed a stuffed animal elephant on her mother's lap and said the elephant sat on Tooky's lap. J.R. told her mother that she was forced to lick the ice cream off the elephant's trunk "while the movie projector was going." (Interviews, p.257)
• At trial J.R. says she had to play an elephant game. She had to lick the ice cream ... off the trunk. The trunk was Tooky's penis. (Vol. 22, pp.124-125)
• Mother remembers J.R. saying that "the fat woman" put her finger in J.R.'s bumbum. She does remember saying that JoAnne put her fingers in J.R.'s vagina. (Vol. 24, p.99)
• J.R. "stated that at the daycare she saw a man put his peepee (child explained this was a penis) in between kid's legs." J.R. did not identify the man. (Interviews, p.257)
• J.R. said that this man's peepee was in the children's mouths as well. Again, J.R. did not identify this man. (Interviews, pp.257-258)
• Miss JoAnne put her fingers in J.R.'s vagina once, in the "secret room." Miss Anne Marie took pictures of this. (Pre-Trial Reports, p.323)
• J.R. told mother that Miss Vi and Miss Cheryl put their fingers in her vagina. Tooky put his finger in her bum. (Grand Jury, 1/18/85, p.13)
• Using anatomical dolls, the prosecutor asks J.R. where she was touched. J.R. says, "In the bum .... Tooky .... with his hands." (Vol. 22, pp.129-130)
• Tooky put his "hands" inside her bum. (Id., p.13o; emphasis added).
• With leading questions, J.R. says "yes .... Tooky" when asked if Tooky ever touched other children in the "secret room." (Vol. 22, p.131)
• Imploring J.R. to help her so she can help other children, Kelley says, "Show me (on the doll) what you told Mommy happened with Miss JoAnne." J.R. replies, "she sticked her finger in. I forget how it works." (Pre-Trial Reports p.322, emphasis added.)
• Mother says that J.R. "mentioned having to drink magic juice that was yellow. It tasted yucky and made her sleepy. She said other children as well had to drink it." (Grand Jury, 1/18/85, p.12)

• Father says J.R. never talked about Fells Acres Day School with him after the one time on 9/13/84 when she told him about an elephant on Tooky's lap. (Vol. 24, p.74)

• Asked by Susan Kelley about ice cream and the elephant, J.R. says she was licking ice cream from a bowl in the kitchen. There was no elephant sitting on anyone's lap. Tooky was "just sitting" in the kitchen. (Pre-Trial Reports, pp.335-336)
• J.R. never saw ice cream on the tail or the penis of the "nice elephant." (Pre-Trial Reports, p.338)
• When asked at the second interview on 9/18/84 if Tooky or other adults touched her, she said, "I don't know." (Interviews, p.254) This was the same response she gave in the first official interview on 9/13/84. (Interviews, p.252)
• J.R. was "the fastest one" eating ice cream. And then "they showed us about the movie .... the cabbage patch and the elephant movie." (Pre-Trial Reports, pp. 335-336)
• There is no body part on Tooky that she touched. (Pre-Trial Reports, p.289)
• J.R. did not see anyone's peepee. (Pre-Trial Reports, p.290)
• Tooky did not make her touch something. (Pre-Trial Reports, p.329)
• Susan Kelley asks J.R., "Did you ever see a magic thermometer inside like this?"

J.R.: "No." (Pre-Trial Reports, p.341)
• J.R. has no secrets from Fells Acres. (Pre-Trial Reports, pp.340-241)
• Using anatomical dolls, Donna Lapsina of DSS asked J.R. if anybody had ever touched her body in any way. J.R. "denied that anybody had done that." (Grand Jury, 1/16/85, p.145)
• At trial she doesn't remember telling Susan Kelley that Miss JoAnne put a finger in J.R.'s private parts. (Vol. 23, p.36)
• J.R. doesn't remember "what kind of stuff" she told her mommy that she used to do at Fells Acres Day School, (Vol. 23, p.42)
• When mother asked her two daughters, J.R. and K.R., both of whom had attended Fells Acres Day School, if anyone had touched them improperly, both daughters said "no." This was on 9/5/84. (Vol. 24, pp.80-81)
• Mother says that J.R.'s sister, K.R., attended Fells Acres Day School at the same time as J.R. K.R. was a year older than J.R. K.R. never made any allegations. (Vol. 23, pp.112,137). J.R. denied any abuse when first asked. (Vol. 23, p.138)
• AS of 12/3/84 Dr. Lynn Cooper terminated therapy with J.R. "According to therapist, child has disclosed absolutely no information in regards to sexual abuse situation." (Interviews, p.262)
• J.R. doesn't remember getting a little police badge. (Vol. 23, p.39)

• DSS worker Donna Lapsina asked J.R. if a big person had told J.R. to keep a secret. J.R. said "yes," and that she was "too scared" to tell who the man was. (Interviews, p.256)
• Mother says J.R. told her she was afraid to tell her "because she was told that mommy and daddy would be killed, and that she was told (by Tooky) that mommy and daddy wouldn't believe her and wouldn't love her anymore." (Vol. 23, p.161)

• J.R. doesn't remember who told her that her mother would die if she was told what was going on. (Vol. 22, pp.132-133)

• In the Susan Kelley interview of 11/21/84, she asks J.R. to "pretend one of the dolls is you, and I want you to show me what you told your mommy." J.R. wants to play with another doll instead.

• See (Interviews, p.291), where M.T. says she saw a penis at school and it was called an elephant. "This response came when she was shown the DSS dolls." (Interviews, p.291; emphasis added).
